Starting A Stim Session

Starting a stim session, the app says “Reconnect” or “Wake up your Somnee”

  • Make sure your mobile device is within Bluetooth range of Somnee and has Bluetooth enabled. 
  • Press the button on Somnee to wake it up. The LED light in the headband should light up yellow. If it doesn’t light up, put Somnee on the charging base to charge.
  • Use the restart button on the settings page of the App to reset the Somnee and the app.
  • If it still doesn’t connect, press and hold the button on Somnee for 8 seconds to reset the headband. Then close and re-launch the Somnee app (fully “swipe close” the app and restart it).
  • When Somnee is connected, and has sufficient power to start the session, the battery icon in the upper right corner of the sleep tab in the app will appear green.

The app says “Charge your Somnee”

  • Place your headband in the charger. You can check in the app settings to see the headband’s battery level.
  • Remember to charge your Somnee between uses.

The app says “Session Timed Out”

  • For safety, there is a software limit on how close together multiple stim sessions can be. After your bedtime session, if you wake up in the middle of the night, you can do a “top-up” session but it needs to be at least 2 hours after your previous session. This is true even if you stopped your first session partially.
  • One top-up session per night.
  • After that you should wait until the next night to use your Somnee. The “session timed out” screen will go away automatically.

Stim Sensation

The stim session sensation is too strong or uncomfortable.

  • It is normal to feel a tingling sensation, or to see some light flashes during the stim session. These effects are harmless and stop as soon as the stimulation stops. 
  • If the sensation is too intense, if you have already used the same set of electrodes for a few nights, change to a new pair of electrodes. Between sessions, place the electrodes (with the flex clip) on top of the charger base with the electrodes facing down to keep them from drying out too quickly.
  • It can be uncomfortable if your hair is caught between the electrodes and your skin. Make sure to pull back your hair before putting the Somnee flex clip on your forehead.
  • Some skin creams and moisturizers are conductive and can make stimulation painful. Wash your forehead before your stim session. Hyaluronic acid-based moisturizers are generally fine to use with Somnee.
  • Press the electrodes to your forehead to ensure good contact. 
  • You can reduce the intensity of stimulation in the Somnee App settings. 
  • If you have acne or broken or irritated skin near the place where the electrodes make contact, you should stop using Somnee until the irritation clears.

I am not feeling any stim sensation.

  • Some people do not feel any stim sensation. This is fine, and does not mean that Somnee isn’t working.
  • If you press the electrodes on to your skin and you feel some sensation, then you should adjust the electrodes or headband to make sure that they are in contact.

The electrodes aren’t touching my forehead or keep losing contact.

  • Adjust the headband so it is snug but comfortable. It should be tight enough that you cannot easily slide it around on your head. 
  • When you place the flex clip on the headband, press the sides of the clip to press the electrodes against your skin. 
  • If only one of the electrodes is properly touching your skin, make sure the band is centered horizontally on your forehead. The button should be above your nose.
  • Typically the bottom of the headband should be on, or just above your brow, but if you do not feel the electrodes touching your skin on both sides, try to adjust the headband up or down a little on your forehead till the electrodes seat properly on your skin.
  • Make sure there is no hair caught between the electrodes and your skin
  • Try to relax and minimize moving around during the stim session.

My hydrogel electrodes feel dry and it’s only been 1 or 2 days.

  • Store at room temperature. Heater may dry out the gel and cold weather may change the consistency of the sticky pads.
  • If you need to change your electrodes early, that’s fine. If you run out, let us know at and we’ll provide more.

Sleep Benefit

I don’t feel like my sleep is improving after I use Somnee.

  • It can take a few days for Somnee’s stim session algorithm to adjust to your individual brain patterns. Keep wearing it at bedtime and give it some time to personalize in the beginning.
  • Soon via a free app update,  you can use the sleep reporting in the Somnee app to quantify your sleep improvement

Somnee Care

Caring for the electrodes:

  • Make sure that between sessions, the electrodes (with the flex clip) is placed on the mound of the charger base with the electrodes facing down to keep them from drying.

Caring for the device:

  • Make sure that between sessions, the Somnee is placed on the charger base. It has a smart charger and it is okay to leave it on the charger always when not in use. This will make sure you do not have to remember to charge before using it.

I got a replacement Somnee and need the app to pair with it.

  • Go to the Somnee App settings, and tap “Remove This Headband” to unpair with your old Somnee. 
  • Press the button on your new Somnee headband to pair it.

Have you done any scientific studies?

Yes. We've done a 3+ year sleep study in our sleep lab in Berkeley, CA and a home pilot with over 1,500 nights of data. Both our sleep study and our pilot were blind, controlled research studies that were overseen by our Scientific Advisory Board and approved by an independent Institutional Review Board. In both studies, Somnee cut the time it takes to fall asleep in half, and reduced the amount of overnight tossing and turning by a third or more.

Who can use Somnee?

We designed Somnee for nearly any adult who wants to improve their sleep, but there are a few people who should not use it. Somnee is not recommended for pregnantwomen, children under 18, epileptics or individuals with a history of seizures, or individuals with implantable metal or electronic devices in their heads or chests. Additionally, individuals with acne or skin abrasions on their foreheads should wait to use Somnee.

Who are the founders of Somnee?

How does Somnee work?

Sleep is a brain activity - a series of electrical patterns in your brain as you transition from a high frequency wake state to low frequency deep sleep. Somnee measures your brain's individual sleep signature, and provides personalized stimulation to safely and effectively promote sleep. Each stim session is personalized automatically, so whether you have trouble falling asleep, or struggle with waking up in the middle of the night, Somnee will adapt to support your sleep needs. How often should I use my Somnee?

Somnee is designed to be used every night so you can get the best possible benefits from both the personalized stim session as well as the sleep tracking technology. Whenever you need a good night's sleep, trust that Somnee will be ready on your nightstand.

What does the Somnee Sleep Service subscription include?

The Somnee subscription plan includes on-going stim session personalization: Somnee’s stimulation settings will automatically adjust to determine the best stim session to improve your sleep. It also includes as many replacement electrodes as you need, delivered right to your door.

Do I need to use my phone with Somnee?

Yes, you need your phone to set up and start a stim session. We designed Somnee to automatically turn off its wifi radio while you are wearing it.

How do I clean it?

The electronic components in Somnee can be easily removed from the headband, and the band can be hand washed with mild soap.


What is a stim session (tES)?

Somnee uses a safe, non-invasive and low intensity electrical stimulation called tES or Transcranial Electrical Stimulation which might sound scary but really isn't. tES has been used for decades to treat conditions like depression and migraine headaches. Somnee gives access to technology typically used only in the laboratory and brings it right to the comfort of your own home.

Is it safe?

Safety is our absolute top priority. Somnee's electrical stimulation has been approved for at-home use in many other products, and Somnee has electrical and software safeguards that limit the amount of stimulation and electrical current to less than 1/10th the amount in consumer electrical muscle stimulator (ie. TENS) units. Somnee follows medical safety practices of no more than 15 minutes for a stim session. We've tested Somnee with hundreds of beta participants for thousands of nights, and we are 100% confident in its safety.

What does a stim session feel like?

A stim session feels like a light tingling sensation on your forehead. Depending on your sensitivity, people describe it as a light scratchy sensation, while others even feel a little warmth at the site of the electrodes. You may also experience a blinking light sensation. When these sensations appear, that's how you know it's working and after a few minutes they fade away. These are normal, safe effects of a stim session, and they stop as soon as the stim session stops. You can always stop a stim session if it becomes uncomfortable, and you can also adjust the intensity of the stimulation using the Somnee app.


How do I change the electrodes and how often should I do it?

Somnee's hydrogel electrodes snap into place easily in the flex clip. The metal part of the electrode should click into the flex clip and the black hydrogel part should touch your skin. Electrodes are reusable. We recommend using the pads for three nights, then replacing them with a new set.

What devices are compatible with the Somnee app?

Somnee is compatible with iPhone and Android smartphones.

Will Somnee's wifi radio turn off when the headband is on my head?

Your Somnee's wifi radio signal will turn off while the headband is on your head.

What happens if I stop paying for the Somnee Sleep Service subscription?

If you stop paying for the Somnee sleep service, you lose access to our personalized sleep algorithms that improve your sleep, as well as the hydrogel pads for your stim sessions, delivered to your doorstep.

Do I need to wear Somnee all night?

You only need to wear your Somnee headband for 15 minutes before going to bed. Your 15 minute stim session will give you all the benefits of falling asleep faster, and sleeping more deeply. If you choose to wear Somnee during sleep, it will track your sleep and use that information to automatically improve future stim sessions. We designed Somnee with luxurious silk and soft cotton padding, so it is comfortable for all types of sleeping positions.

Can I travel with my Somnee?

Yes, it's safe and highly-encouraged that you travel with your Somnee. The TSA and FAA allows small electronic devices like Somnee to be taken with you in your carry-on baggage.

Is my Somnee safe to use with other sleep aids?

Over-the-counter sleep aids are safe to use with your Somnee headband. Consult your doctor if you wish to use Somnee with prescribed sleep medications.

What happens if I forget to do a stim session or wear my Somnee?

To get the full benefits from your Somnee, it's best to wear your headband every night. Somnee is made to be there for you whenever you need to guaruntee a good night's sleep so don't worry if you miss a session, we've got your back!

Will insurance cover the cost of Somnee?

Somnee and the Somnee Sleep Service are generally covered by Flexible Spending Accounts (FSA's) and Health Savings Accounts (HSA's). If you have a FSA/HSA-linked credit or debit card, you can use it to check out on Somnee is not generally covered by primary health insurance providers. 

Can multiple people share one Somnee?

No, Somnee is personalized based on your brain's individual sleep patterns, and every member of the household needs their own Somnee.

StimScience Inc., in Berkeley, CA, is the manufacturer of the Somnee headband, the operator of the Somnee Sleep Service and Somnee App, and the operator of the and websites (the “Websites”).  StimScience, which may be referred to in this Privacy Notice as “StimScience,” “we,” or “us”, provides this Privacy Notice to inform visitors to our Websites and users (“you”) of our products, services and Websites  (collectively, the “Services”) of our policies and procedures regarding the collection, use and disclosure of information received from or about you. 

StimScience will not sell your information to a third party or use it in advertising.  We may share your information with selected third parties solely to facilitate your relationship with us, as further described below.

By using our Services, you are acknowledging the terms of this Privacy Notice and consenting to our processing of your information as set forth in this Privacy Notice now and as amended by us from time to time. “Processing” means using or handling information in any way, including, but not limited to, collecting, storing, deleting, using, combining and disclosing information and transferring it within the United States and internationally.

Information Collection 

Biometric Information.  StimScience collects biometric data. The data we collect includes passive brain measurements and motion data collected with the Somnee headband. This biometric data may be used to track the duration of your sleep each night, your brain activity before and during sleep, and your motion before and during sleep. In addition, we may ask you to provide subjective or behavioral information about your sleep and your usage of the Somnee headband.

Personally Identifiable Information. Personally Identifiable Information (“PII”) is information that can be used to identify you.  In connection with the use of our Services, PII that we may collect includes your name, email address, age, mailing address, telephone number, credit card data and IP address.

Methods of Data Collection. In general, it is not necessary to provide us with PII in order to view our Websites.   If you wish to be placed on our mailing list to receive additional information about our Services, you will be asked to provide your name and email address.  Optionally, you can provide your telephone number.

If you order Services from our Websites, you must provide your name, credit card information, email address and physical address, and optionally, your telephone number.  

Most of the information we collect is specifically provided by users of our Services.  Some information is collectively passively.  For example, when you use the Somnee headband, biometric data is automatically transmitted to a cloud service.  Our online applications collect IP addresses from your devices.

If you contact us by email through the Websites, we may keep a record of your contact information and correspondence, and may use your email address, and any information that you provide to us or is contained in your message, to respond to you. Please do not provide us with any sensitive information.

Information Use

Purpose. Our primary goal in collecting information is to monitor and improve our Services, respond to your inquiries and to provide you with information that you request from us via your use of the Services.

Certain information, such as name, address and credit card data, is necessary to fulfill orders and facilitate payment for our Services.

Biometric data may be used for future product development, regulatory purposes, and scientific journal submission.

Your choices and access to your information

Required Information. Except for telephone numbers, the information requested of you when using our Services is mandatory.  If you do not wish to provide such information, you will not be able use those Services.

Changing or Deleting Information. If you want to know the PII or Biometric information we hold about you, or to have us delete such information, or to modify your PII, please contact us via our Contact page with your request. We’ll take steps to honor your request as soon we can, but some information may remain in archived/backup copies for our records or as otherwise required by law.

Marketing Information.  We regularly send out emails to our customers to keep them updated on new and improved Services and tips for using our Services as well as providing promotional offers.  If you do not wish to receive these emails, you will have the ability to unsubscribe.

Information Sharing and Disclosure

Service Providers. StimScience may employ third party companies and individuals to facilitate the provision of Services via the Websites or otherwise, or to perform certain Website-related services (e.g., hosting and maintenance services, database management and improvement of the Websites’ features). We may from time to time share your PII with such third parties to administer or complete these tasks. These third parties shall only have access to your information as necessary to perform their functions and may not use it for any other purpose.

Sharing of Information. StimScience will not share PII with any third party whom it knows or reasonably should know plans to use the information to contact or track you or who may transfer the information to any other parties.

Compliance with Laws and Law Enforcement. If legally requested, StimScience may cooperate with government and law enforcement officials or private parties, to enforce and comply with the law. We may disclose any information about you, including PII, to government or law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate to respond to claims or legal process (including subpoenas), to protect the property and rights of StimScience or a third party, the safety of the public or any person, to prevent or stop any illegal, unethical, or legally actionable activity, or to comply with the law.

Business Transfers. If any or all of the assets of StimScience are acquired by, or merged with, another entity, we will share some or all of your information with such entity.

Information Security and Retention 

Security.  StimScience is very concerned about safeguarding the confidentiality of information that we collect about you (including your PII). We take reasonable administrative, physical and electronic measures designed to protect your information from unauthorized access, use or disclosure. Biometric data is pseudonymized (linked to age, time zone, and a customer identifier, but separated from your PII). That data is stored in a password protected system that can only be accessed by members of our neuroscience team, as designated by our CTO.  Billing data is stored in password protected third party systems. The data can only be accessed by a limited number of individuals within the company, on a need to know basis.

Please be aware, however, that no method of transmitting information over the Internet or storing information is completely secure. Accordingly, we cannot guarantee the absolute security of any information.

Retention.  Our intent is to only retain your data for so long as it is useful to us.  To that end, we periodically purge our files of outdated information.

Other Issues

Cookies.  A cookie is a small text file that a website places on a user’s computer (including smartphones, tablets or other connected devices) to store information about the user’s activity.  StimScience uses cookies to improve and personalize the information on our Websites and to improve our marketing emails and advertisements.  Your use of our Services is deemed to constitute consent for the use of cookies for such purposes.

Responding to Do Not Track Signals.  Our Websites do not have the capability to respond to “Do Not Track” signals received from various web browsers.

Third Party Sites.  This Privacy Notice only applies to our Services and does not apply to any third-party websites, products, applications or services, even if they are accessible through our Services.  If you are linked to our Websites from a third party website or application, be aware that StimScience has no control over the data privacy practices of such websites or applications.

Our Policy Towards Minors.  Our Websites and other Services are not directed to children under age 18. If a parent or guardian becomes aware that his or her child has provided us with PII without their consent, please contact us via the contact page.

Changes in this Privacy Notice.  This Privacy Notice may be updated from time to time at our discretion. We will notify you of any material changes by posting the revised Privacy Notice on this Website and updating the “Last Updated” date. (“StimScience”) has developed a proprietary system which uses light electric stimulation to promote sleep utilizing a specially designed device (“Somnee”), in combination with personalization of the stimulation settings and monthly replenishment of Somnee electrodes (the “Somnee Subscription”).


YOUR USE OF THE SERVICE CONSTITUTES YOUR AGREEMENT TO THESE TERMS, CONDITIONS, COVENANTS, POLICIES AND NOTICES (THESE “TERMS OF USE”). IF YOU DO NOT AGREE WITH ALL OF THE TERMS OF THESE TERMS OF USE, YOU ARE PROHIBITED FROM USING THE SERVICE. If you are using or accessing the Service on behalf of an entity, such as a company, a sports team or organization, then you represent to us that you have the power and authority to bind such company, sports team or organization to these Terms of Use.

Your use of the Service is subject to these Terms of Use and StimScience’s Privacy Policy. For purposes of these Terms of Use, the terms “we,” “us” and “our” refer to StimScience. “You” refers to you, as a user of the Service. 

Requirements to Use the Service

The Service is offered and available to users who are 18 years of age or older and reside in the United States or any of its territories and possessions. Furthermore, the Service is only offered to users who (i) are not incapable of giving consent, (ii) are not pregnant or possibly pregnant, (iii) are not utilizing an active implanted medical device, (iv) do not have a skull defect or any implant in his/her skull, and (v) do not have epilepsy or a history of seizures. By using the Service, you represent and warrant that you are of legal age to form a binding contract with StimScience and meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access or use the Service.

The Service may only be used with a Somnee manufactured, distributed, or sold by or on behalf of StimScience. You may not connect to the Service with any device that is not manufactured, distributed, or sold by or on behalf of StimScience (such as a knock off or counterfeit version of Somnee); otherwise intends to resemble or purports to be a Somnee; or any unauthorized application or-third party connection. Any violation or attempted violation of this provision may result in the immediate termination of your ability to access the Service.

Account; Account Security

To use the Service, you must create an account by providing us with a valid email address. You can access your account information at any time through the Service. You agree that you will supply truthful, accurate and complete information to StimScience, and that you will update such information promptly in the event that it changes. If you are using the Service on an enterprise level for multiple individual user accounts, then you shall designate one user as the administrative user who shall be responsible for registering and, if desired, editing the account information. Any change in the designation of the administrative user must be submitted to StimScience by the current administrative user. You acknowledge that if any information provided by you is untrue, inaccurate, not current or incomplete, StimScience may terminate your use of the Service.

You are responsible for maintaining the confidentiality of your account and for all activities which occur through the use of your account. You agree to: (i) immediately notify StimScience of any unauthorized access to or use of your account or any other breach of security; and (ii) ensure that you secure your account, computer and mobile device from third party access. StimScience will not be liable for any loss or damage arising from your failure to comply with this Section.

You agree that all information you provide to register with the Service or otherwise is governed by our Privacy Policy, and you consent to all actions we take with respect to your information consistent with our Privacy Policy.

Grant of a Limited License

Subject to your agreement to and continuing compliance with these Terms of Use (including the limitations set forth in Section 4 below), StimScience grants you a personal, non-exclusive, non-assignable, non-transferable license (without the right to sublicense) to access and use the Service for your personal and non-commercial use only. You may not use the Service for any other purpose.

License Limitations

You agree that you will not and will not permit any party to:

  • modify, copy, distribute, transmit, display, perform, reproduce, duplicate, publish, license, create derivative works from, or offer for sale any information contained on, or obtained from or through, the Service;

  • duplicate, decompile, reverse engineer, disassemble or decode the Service (including any underlying idea or algorithm), or attempt to do any of the same;

  • use, reproduce or remove any copyright, trademark, trade names, slogan, logos, images, service marks or other proprietary notations displayed on or through Service;

  • frame or utilize any framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout or form) of StimScience without our express consent;

  • attempt to gain unauthorized access to, interfere with, damage or disrupt the Service, accounts registered to other users, or the computer systems or networks connected to the Service;

  • circumvent, remove, alter, deactivate, degrade or thwart any technological measure or content protections of the Service;

  • use any robot, spider, crawlers or other automatic device, process, software or queries that intercepts, “mines,” scrapes or otherwise accesses the Service to monitor, extract, copy or collect information from or through the Service, or any manual process to do the same;

  • introduce any viruses, trojan horses, worms, logic bombs or other material which is malicious or technologically harmful;

  • use the Service for illegal, harassing, unethical, or disruptive purposes;

  • violate any applicable law or regulation in connection with your use of the Service; or use the Service in any way not expressly permitted by these Terms of Use.
Data and Intellectual Property Ownership

As between you and StimScience, all software (including source code), logos, icons, the Service’s “look and feel,” text, graphics, images, video clips, sound clips, content, notices, data, page layout, and selection and arrangement of the content and all copyrights, patents, trade secrets, trademarks and other intellectual property rights therein are owned solely and exclusively by StimScience and are protected by United States and international copyright, trade secret or other intellectual property laws and treaties. StimScience and its licensors reserve all rights in connection with the Service and its content including, without limitation, the exclusive right to create derivative works therefrom. Except for the limited license granted to you in Section 3, you have no right, title or interest in or to the Service and any such content.

The Somnee name and all related names, logos, product and service names, designs and slogans, are trademarks of StimScience or its affiliates or licensors. Other names, logos, product and service names, designs and slogans that appear on the Service are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by StimScience.

Third Party Websites, Apps or Resources

The Service may provide links to other websites, apps or resources by third parties (“Third Party Sites”). These Third-Party Sites are provided for your convenience only and are not reviewed, controlled, examined, sponsored, or endorsed by StimScience and StimScience is not responsible for the information, advertising, products, resources or other material of any Third-Party Site, or any link contained in a Third-Party Site. YOUR USE OF ANY SUCH THIRD-PARTY SITES IS AT YOUR OWN RISK. None of the StimScience Parties (as defined in Section 13) shall be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of, inability to use or reliance on any such content, goods or services available on any Third-Party Sites.

Consult Your Doctor Before Using the Service

Our goal is to provide a useful Service, but we make no endorsement, representation or warranty of any kind about any information, services or recommendations made available on the Service. The accuracy of the data collected and presented through the Service is not intended to match that of medical devices or scientific measurement devices. The Service is intended to be used for general wellness, and is not to be used for the diagnosis, cure, prevention, or treatment of any disease or medical condition. Seek the advice of your physician or health care provider before using the Service, if you have questions or concerns about sleep health, and never disregard professional medical advice or delay in seeking it because of the Service. You should not use the Service if you:

  • are not capable of giving consent;

  • are a woman who is pregnant or possibly pregnant (neurostimulation has not been thoroughly studied in pregnant women);

  • have an active, implanted medical device such as a pacemaker, defibrillator, or other neurostimulator;

  • have a skull defect (i.e., plate in the skull or previous reconstructive skull surgery) or any implant in the portion of the skull overlying the brain (neurocranium); or

  • have epilepsy or a history of seizures.

Furthermore, Somnee should not be used in any way contrary to the instructions for use provided by StimScience. Somnee and its electrodes should not be used over broken skin.

If you experience a medical emergency, stop using the Service and consult with a medical professional. We are not responsible for any health problems that may result from sleep programs, consultations, products, or events you learn about through the Service. If you engage in any sleep program you receive or learn about through the Service you agree that you do so at your own risk and are voluntarily participating in these activities.

Alerts and Notifications

Anyone who believes that his or her work has been reproduced in the Service in a manner which constitutes copyright infringement may submit a notification to StimScience’s copyright agent in accordance with the Digital Millennium Copyright Act (the “DMCA”), by providing the following information in writing:

  • identification of the copyrighted work that is claimed to be infringed;

  • identification of the allegedly infringing material that is requested to be removed, including a description of where it is located on the Service;

  • information for our copyright agent to contact you, such as an address, telephone number, and, if available, e-mail address;

  • a statement that you have a good faith belief that the identified, allegedly infringing use is not authorized by the copyright owners, its agent or the law;

  • a statement that the information above is accurate, and under penalty of perjury, that you are the copyright owner or the authorized person to act on behalf of the copyright owner; and

  • a physical or electronic signature of a person authorized to act on behalf of the owner of the copyright or of an exclusive right that is allegedly infringed.

If you are asserting infringement of an intellectual property right other than copyright, please specify the intellectual property right at issue (for example, “trademark”) by notating this in your written notice. If you fail to comply with all of the requirements for a notice of infringement as specified above, your DMCA notice may not be valid.

It is StimScience’s policy, in appropriate circumstances and at its discretion, to disable or terminate the accounts of users who repeatedly infringe copyrights or intellectual property rights of others.

Changes to Terms of Use

StimScience may revise and update these Terms of Use at any time in our sole discretion. StimSciece will publish such revisions and updates from time to time by posting the revised policy on the Service and updating the “effective as of” date at the top of this page. If the changes are material, we will include “recently updated” next to the link to this policy on the Service for 30 days after the date of the change. If you do not agree to the changes, then you must immediately stop using the Service.


As a user of the Service, we may ask you from time to time for your input and feedback regarding the Service, or for other information relating to your experiences and practices relating to the Service. Any such input, feedback or information you provide will become our property and you assign all rights in such input, feedback and information to us, and we may use that information for our business or other purposes, including without limitation continuing to improve the Service.


These Terms of Use are effective until terminated. You may terminate these Terms of Use by discontinuing your use of the Service (including Somnee) and deleting the Somnee App from your mobile device.

StimScience reserves the right to terminate these Terms of Use, and/or temporarily or permanently suspend, withdraw or restrict your access to some or all of the Service, at any time, effective immediately with notice, in the event of any conduct by you which StimScience, in its sole discretion, considers to be unacceptable or a violation of these Terms of Use. If StimScience terminates or restricts your use and access of the Service, then you must immediately stop using all portions of the Service and delete the Service from your mobile device. All sections which by their nature should survive the expiration or termination of these Terms of Use shall continue in full force and effect notwithstanding the expiration or termination of these Terms of Use.

Warranty; Warranty Disclaimer

The Service may be temporarily unavailable from time to time for maintenance or other reasons. StimScience shall have no responsibility for any interruption, delay in operation or transmission, theft or destruction of, unauthorized access to, or alteration of, any other content made available via the Service.


StimScience warrants to the original purchaser that your Somnee shall be free from defects in materials and workmanship under normal use for a period of six (6) months from the date of purchase (the "Warranty Period"). This Limited Warranty is valid only in the jurisdictions where the Products are sold by StimScience itself.

StimScience does not warrant that the operation of Somnee will be uninterrupted or error-free. StimScience is not responsible for damage arising from failure to follow instructions relating to Somnee’s use or failure to comply with the Terms of Use.

If a hardware defect arises and a valid claim is received by StimScience within the Warranty Period, StimScience will, at its option and to the extent permitted by law, either (1) repair Somnee at no charge, using new or refurbished replacement parts or (2) replace Somnee with a new or refurbished Somnee. In the event of a defect, to the extent permitted by law, these are your sole and exclusive remedies. Shipping and handling charges may apply. Any replacement hardware product will be warranted for the remainder of the original warranty period or thirty (30) days, whichever is longer.

This Limited Warranty does not cover software embedded in Somnee and it does not cover the Somnee Subscription or Somnee App. This Limited Warranty applies only to Somnee manufactured by StimScience that can be identified by the “Somnee” trademark, trade name, or logo affixed to it. Furthermore, this Limited Warranty does not apply to any (a) Somnee products and services other than the Product, (b) non-Somnee hardware product, (c) Products purchased from any party other than StimScience, (d) Products purchased through online auctions, or (e) consumable spare parts and accessories (unless they are found to be non-functional or broken upon purchase of Somnee), such as electrodes, pouches, lanyards, cases and case parts.

This Limited Warranty does not apply to Somnee or part of Somnee that has been altered or modified (e.g., to alter functionality or capability) by anyone who is not a representative of StimScience. 

Somnee is hand-washable with water or mild cleaners, and the electronics should be removed from the headband prior to cleaning. Any damage resulting from machine washing, submersion in water, or use of abrasive or chemical cleaners will void the Limited Warranty. 

Limitation of Liability



THE FOREGOING LIMITATIONS WILL APPLY EVEN IF THE ABOVE STATED REMEDY FAILS OF ITS ESSENTIAL PURPOSE. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, the liability of StimScience Parties shall be limited to the fullest extent permitted by law. THEREFORE, THE FOREGOING LIMITATIONS SHALL APPLY TO THE MAXIMUM EXTENT PERMITTED BY LAW.


You agree to indemnify and hold each of the StimScience Parties harmless from and against any and all liabilities, expenses, damages, losses, fines or penalties (including reasonable attorneys’ fees) incurred by the StimScience Parties in connection with any claims, causes of action or demands against the StimScience Parties arising out of or related to: (a) your access to or use of the Service, (b) any act of fraud or dishonesty by you in connection with your use of the Service, (c) any damage and/or any of the other medical conditions arising from or relating to the use of the Service by you (including any resulting from your failure to comply with Section 7 of these Terms of Use) or (d) any breach by you of these Terms of Use or any applicable laws or any unauthorized use of the Service. We reserve the right to assume control of the defense of any third-party claim that is subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses.

Equitable Remedies

In the event that you breach these Terms of Use, you hereby agree that StimScience would be irreparably damaged if these Terms of Use were not specifically enforced, and therefore StimScience shall be entitled, without bond, other security, or proof of damages, to appropriate equitable remedies with respect to breaches of these Terms of Use, in addition to such other remedies as StimScience may otherwise have available to it under applicable laws.

Dispute Resolution and Governing Law

  • Informal Negotiations. To expedite resolution and control the cost of any dispute, controversy or claim related to these Terms of Use (“Dispute”), you and StimScience agree to first attempt to negotiate any Dispute (except those Disputes expressly provided in Section 17.D below) informally for at least thirty (30) days before initiating any arbitration or court proceeding. Such informal negotiations commence upon written notice from one person to the other. StimScience will send its notice to your billing address and email you a copy to the email address you have provided to us. You will send your notice to StimScience, Inc., 2115 Milvia Street, Suite 400, Berkeley, CA 94704, USA.

  • Binding Arbitration. If you and StimScience are unable to resolve a Dispute through informal negotiations, either you or StimScience may elect to have the Dispute (except those Disputes expressly excluded in Section 17.D below) finally and exclusively resolved by binding arbitration. Any election to arbitrate by one party shall be final and binding on the other. YOU UNDERSTAND THAT ABSENT THIS PROVISION, YOU WOULD HAVE THE RIGHT TO SUE IN COURT AND HAVE A JURY TRIAL. The Dispute shall be submitted to arbitration by one arbitrator mutually agreed upon by the parties, and if no agreement can be reached within thirty (30) days after names of potential arbitrators have been proposed by JAMS, then by one arbitrator having reasonable experience in disputes of the type provided for in this Agreement and who is chosen by JAMS. The arbitration shall take place in San Francisco, California. The arbitration shall be administered by JAMS pursuant to its Comprehensive Arbitration Rules and Procedures and in accordance with the Expedited Procedures in those Rules or pursuant to JAMS' Streamlined Arbitration Rules and Procedures. The arbitration shall be governed by the Federal Arbitration Act, 9 U.S.C. §§1 et. seq., and except as set forth below, the arbitral award shall be final, binding and incontestable and judgment thereon may be entered in any court of competent jurisdiction. The arbitrator shall award only such damages as are permitted to be awarded pursuant to these Terms of Use, each party expressly waives and foregoes any right to punitive, exemplary or similar damages unless applicable law prohibits such waiver. The arbitrator must render their award within thirty (30) days following the last hearing scheduled by the arbitrator and at that time state the reasons for their award in writing. An appeal may be taken under the JAMS Arbitration Appeal Procedure from any final award of an arbitral panel in any arbitration arising out of or related to these Terms of Use that is conducted in accordance with such procedure. Unless otherwise agreed by the parties and the appeal tribunal, the appeal shall be conducted at the place of the original arbitration. 

  • Restrictions. You and StimScience agree that any arbitration shall be limited to the Dispute between StimScience and you individually. To the full extent permitted by law, (1) no arbitration shall be joined with any other; (2) there is no right or authority for any Dispute to be arbitrated on a class-action basis or to utilize class action procedures; and (3) there is no right or authority for any Dispute to be brought in a purported representative capacity on behalf of the general public or any other persons. Any Dispute not subject to arbitration, or where no election to arbitrate has been made, shall be decided by a court of competent jurisdiction within the state courts of California or the United States District Court for the Northern District of California, and you hereby agree to submit to the personal jurisdiction of that court. 

  • Exceptions to Informal Negotiations and Arbitration. You and StimScience agree that the following Disputes are not subject to the above provisions concerning informal negotiations and binding arbitration: (1) any Disputes seeking to enforce or protect, or concerning the validity of, any of your or StimScience’s intellectual property rights; (2) any Dispute related to, or arising from, allegations of theft, piracy, invasion of privacy or unauthorized use; and (3) any claim for injunctive relief. 
Governing Law

Except as expressly stated otherwise, these Terms of Use shall be governed by, and will be construed under, the laws of the United States of America and the law of the State of California, without regard to choice of law principles. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.

Apple App Store

The following terms and conditions apply to you only if you are using the Somnee App that you have downloaded from the Apple App Store (a “Somnee Apple App”). To the extent the other terms and conditions of the Terms of Use are less restrictive than, or otherwise conflict with, the terms and conditions of this paragraph, the more restrictive or conflicting terms and conditions in this paragraph apply, but solely with respect to use of any Somnee Apple App downloaded from the Apple App Store. You acknowledge and agree that these Terms of Use are solely between you and StimScience, not Apple, and that Apple has no responsibility for the Somnee Apple App or content thereof. Your use of the Somnee Apple App must comply with the App Store Terms and Conditions. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Somnee Apple App. In the event of any failure of the Somnee Apple App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, for the Somnee Apple App to you; to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Somnee Apple App, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be solely governed by these Terms of Use. You and StimScience acknowledge that Apple is not responsible for addressing any claims of you or any third party relating to the Somnee Apple App or your possession and/or use of the Somnee Apple App, including, but not limited to: (i) product liability claims; (ii) any claim that the Somnee Apple App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation. You and StimScience acknowledge that, in the event of any third party claim that the Somnee Apple App or your possession and use of that Somnee Apple App infringes that third party’s intellectual property rights, StimScience, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim to the extent required by these Terms of Use. You must comply with applicable third party terms of agreement when using the Somnee Apple App.

General Provisions

  • Assignment. StimScience may assign these Terms of Use, in whole or in part, to any person or entity at any time with or without your consent. You may not assign these Terms of Use, or assign, sublicense, pledge, or otherwise transfer or share the benefit of any or all of your rights, if any, in the Service, and any attempt to the contrary is void.

  • Severability. If any provision of these Terms of Use shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms of Use and shall not affect the validity and enforceability of any remaining provisions.

  • No Waiver. No waiver by either party of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default.

  • Entire Agreement. These Terms of Use are the complete and exclusive statement of the agreement between you and StimScience concerning the Service, and these Terms of Use supersede any prior or contemporaneous agreement, either oral or written, and any other communications with regard thereto between you and StimScience.

  • Headings. The section headings used herein are for reference only and shall not be read to have any legal effect.

Is it normal to have skin irritation?

We work hard to ensure Somnee is safe for all of our customers, however, a small number of users may experience skin irritations as a reaction to certain materials, we want everyone to feel comfortable using our product, here are our recommendations:

  1. Some skin creams, moisturizers, and natural skin oils can increase sensitivity to stimulation. Please wash your forehead and ensure it’s fully dry before using Somnee.

  2. Your electrodes may have dried out. To keep electrodes at peak performance, we recommend storing them at room temperature and swapping them out for new ones every 3 nights, whether you’ve used your Somnee or not.

  3. Hair or dust can interfere with stimulation, so make sure your electrodes are making full contact with your skin.

  4. Some with pre-existing skin conditions (e.g., acne, eczema, scars) may experience skin irritation with Somnee. Please allow your skin to fully heal before using Somnee.

  5. The stimulation intensity may be too high for your skin. You can adjust it to a more comfortable lower level in the settings tab in the Somnee App.


Where can I find sleep reporting?

Tap the Reports icon in the tab bar of the Somnee app.

Do I have to wear Somnee all night to get a sleep report?

No you don’t. There are two types of metrics in the sleep report: sleep quality predictions that are based on your brain state right at the end of your stim session – these metrics are available for nights that you use Somnee; and overnight sleep summaries– these only show up for nights where you sleep with your Somnee on overnight and you have good contact.

Is my data secure?

Why don’t the results match up with my smart watch or smart ring?

Most sleep trackers measure movement or heart rate, and use that data to estimate whether you were asleep or awake. But sleep is a brain activity, which is why professional sleep labs rely on brain signals to measure sleep. When compared to the sleep lab standard (polysomnography), most sleep reports from apps, watches, or smart rings are only 65-70% accurate. Because Somnee measures brain activity directly, our overnight sleep reporting models are able to achieve a best-in-class 80% accuracy. In addition, every sleep tracking device can have variation in sleep metrics based on fit, movement, or other factors.

Why doesn’t my overnight sleep summary show up for every night?

Sleep reports are only available for nights that you use your Somnee, and overnight sleep summaries only show up for nights where you sleep with your Somnee on overnight. In addition, Somnee automatically filters out nights where the data indicates that the headband was loose or not in good contact with your forehead overnight. If this happens regularly, try tightening your headband slightly - it should be snug but comfortable.
